"Beating Woman 5 Days Before Suicide Not Abetment U/S 306 IPC Without Proof Of Intent": Chhattisgarh HC Sets Aside 10-Year Jail Sentence

Can a physical assault automatically become abetment of suicide when the victim dies five days later? The Chhattisgarh High Court overturned the 10-year imprisonment of four accused, explaining why assault alone cannot establish Section 306 IPC.

CHHATTISGARH: The Chhattisgarh High Court has acquitted persons convicted of abetment of suicide under Sections 306 and 34 IPC, holding that an earlier assault, without proof of intention to instigate suicide, is insufficient for conviction.

Justice Naresh Kumar Chandravanshi set aside the Second Additional Sessions Judge's judgment, which had sentenced the four accused to 10 years of rigorous imprisonment.

The case concerned a woman who was present at her prospective husband's house. The accused, who were her distant relatives, objected to the couple being together. An argument followed, during which both the woman and her prospective husband were assaulted.

Five days after the incident, the woman consumed poison and died by suicide. The prosecution claimed that the assault and humiliation had driven her to take the extreme step.

The accused challenged their conviction, arguing that the dispute did not involve any intention to provoke suicide. They also questioned the alleged suicide note, submitting that the handwriting expert's report had not been properly proved.

The High Court found that the assault had been established. However, it clarified that proving an assault and proving abetment of suicide are two different legal requirements.

For conviction under Section 306 IPC, the prosecution must establish direct or indirect instigation, a sufficiently close connection with the suicide, and the necessary criminal intention, known as mens rea.

The Court observed that the incident had occurred approximately five days before the woman's death. It found no evidence establishing that the accused had assaulted her with the intention of pushing her towards suicide.

The Court consequently set aside the conviction and sentence under Sections 306/34 IPC and acquitted the surviving appellants. Proceedings against one appellant had already abated following his death.
